ORDINANCE TO BECOME LAW 3/24/2026

Ordinances #413-2026 and 414-2026 were passed on their second reading at the 2/24 Council meeting.
These ordinances are regarding telecommunications companies working in the City’s rights-of-way.
#413-2026 establishes Chapter 29 of the Three Forks Zoning Code and covers all the requirements and regulations for telecommunications infrastructure and service providers who will have their equipment in our right-of-way. These are the transmission between a user and the provider. This includes the application process, permitting, fees, terms, conditions, insurance, construction and security bonds, franchise agreements, leases, taxes, damage to property, notice of work to occur, maintenance and repair, etc. This is a 17-page document which may be found at the link below.
#414-2026 establishes Chapter 30 of the Three Forks Zoning Code and covers all the requirements and regulations for small cell and small wireless facilities. These are typically mounted on other structures (like power or light poles, or even buildings) 50-feet or less in height. This ordinance also covers the process of applications, permits, maintenance and repair, construction and security bonds, collocation requirements, design specifications, construction, noise study requirements, traffic control, etc. This is a 16-page ordinance.
